Presale Buyers With a Non-First-Time Partner: What You Keep in BC (2026)
By Uzair Muhammad · Published
One partner owned before? You may still use the GST rebate, HBP, FHSA and BC's new-build PTT exemption on a presale. Here's the test each uses.
If one half of a couple has owned a home before, you can still use most first-time-buyer breaks on a BC presale, but not all of them, and one rule decides which. Each program tests a different person in a different way, and at a $750,000 presale the BC new-build transfer tax exemption can cover the gap the first-time-buyer exemption leaves.
The Short Answer
Couples are often told "you're not first-time buyers anymore" the moment one partner has a past ownership history. That is rarely the full picture. The BC first-time home buyers' property transfer tax (PTT) exemption, the federal first-time buyer GST rebate, the Home Buyers' Plan (HBP) and the FHSA each use their own definition. The partner who never owned may still qualify for several of them, as long as they have not lived in a home the other partner owned in the look-back window.
Who Each Program Actually Tests
| Program | Who is tested | What a past owner does to you |
|---|---|---|
| BC first-time buyer PTT exemption | Every purchaser, individually | Only the first-time buyer's percentage of title is exempt (gov.bc.ca) |
| BC newly built home PTT exemption | Each purchaser: citizen or PR, owner-occupier | Nothing. No first-time-buyer status is required |
| Federal first-time buyer GST rebate | At least one purchaser; only one member applies | The qualifying partner can still carry the claim |
| HBP and FHSA | Each person's own withdrawal or account | Disqualifies you only if you lived in a home you or your spouse owned in the look-back window |
The hidden trap is the look-back. Under CRA's HBP definition you are not a first-time buyer if, in the current calendar year or the preceding four, you lived in a home you owned or that your current spouse or common-law partner owned. If your partner's old condo was also your home, you may be out too, even though your name was never on title. The federal GST rebate uses a similar test over five years.
The Thresholds That Matter in 2026
BC first-time buyer PTT exemption
Full exemption up to $835,000 fair market value, partial exemption below $860,000. Both citizens or permanent residents; BC residency test; principal residence only.
BC newly built home exemption
Full exemption up to $1,100,000, partial up to $1,150,000. Move in within 92 days of registration and live there at least one year.
Federal first-time buyer GST rebate
Refunds the 5% GST up to $50,000 on homes up to $1,000,000, phasing to $0 at $1,500,000. Applies to agreements signed after May 26, 2025.
HBP and FHSA
HBP lets each eligible buyer withdraw up to $60,000 from an RRSP. FHSA allows $8,000 a year and $40,000 lifetime per person.
Worked Example: $750,000 Surrey Presale, 50/50 Title
Partner A has never owned and never lived in a home Partner B owned. Partner B sold a condo two years ago. Both are Canadian citizens living in BC and will live in the unit.
| Item | Result |
|---|---|
| PTT with no exemption (1% on first $200,000, 2% on the rest) | $13,000 |
| PTT using only the first-time buyer exemption (A's 50% share) | $6,500 payable |
| PTT using the newly built home exemption (both owner-occupiers) | $0 |
| GST at 5% on the price | $37,500 |
| GST rebate if A qualifies (price under $1,000,000) | Up to $37,500 |
| HBP and FHSA room | A only, up to $60,000 HBP |
The mixed-history couple pays $0 PTT only because the newly built exemption stands on its own. Above $1,150,000 neither PTT exemption applies, and above $1,500,000 the GST rebate is gone.
Check before you sign: I have not found CRA guidance on whether the GST rebate is reduced when a co-purchaser who has owned before shares title. The rules require that one purchaser qualifies and that only one applies, but confirm the amount with your lawyer or accountant before you count on the full figure.
What to Do Before Signing
Write down every address either of you lived at over the past five years and who owned it. Confirm the owner-occupier plan: moving in within 92 days of registration and staying a year is what unlocks the newly built exemption. Decide title shares with your lawyer, not for tax reasons alone, because your lender cares about both incomes. Then compare the first-time buyer route against the newly built route on your exact price.
Why This Gets Missed
A presentation centre sells the unit, not your tax position. Reps rarely ask who owned what in the past five years, and a developer's brochure will say "first-time buyers save" without explaining that each program has a different test. Because we represent buyers only, we map this before you commit a deposit.
The Bottom Line
One partner having owned before does not disqualify you from the BC presale tax breaks, but it changes which ones carry the weight. At $750,000 the newly built exemption covers PTT, and the other partner can still carry the GST rebate, HBP and FHSA if they pass the look-back test.
