## The Definition of a Presale
A presale condo (also called a "pre-construction" condo) is a unit you purchase before it's built. You're essentially buying based on floor plans, renderings, and a developer's promise to deliver a finished home — usually 2-4 years down the road.
In British Columbia, presale condos are governed by the Real Estate Development Marketing Act (REDMA), which provides certain buyer protections. The developer must file a Disclosure Statement with the BC Superintendent of Real Estate before they can legally market or sell any units.
## The 7-Day Rescission Period
One of the most important protections for BC presale buyers is the 7-day rescission (cooling off) period. After you sign the Contract of Purchase and Sale and receive the Disclosure Statement, you have 7 calendar days to cancel the contract for any reason — no questions asked.
Key things to know:
- The 7-day period starts when you receive the Disclosure Statement, not when you sign.
- You must provide written notice to the developer to exercise your rescission right.
- Any deposits paid must be fully refunded within 15 days.
- This is your last chance to back out without penalty — use this time to review the contract with an independent advisor.
## How the Deposit Structure Works
Presale deposits in BC typically follow a structured schedule:
1. **Initial deposit (5%):** Due at signing or within a few days.
2. **Second deposit (5%):** Due 30-60 days after signing.
3. **Third deposit (5%):** Due at 180 days after signing.
4. **Balance (85%):** Due at completion, typically financed by your mortgage.
Your deposit is held in trust by the developer's lawyer and is protected under REDMA. In most cases, your money is safe — but understanding the fine print is critical.

- **2-5-10 Warranty:** BC's new home warranty covers defects for 2 years, building envelope for 5, and structure for 10.
